Active Building Management (Active): Terms of Trade

“Terms of trade” are the terms of the contract between a seller of goods or services (Active) and the buyer (Client/Customer). Active provides its goods and services in good faith that the goods and services will be paid for in line with these terms of trade. These terms of trade are intended to ensure a positive outcome for both parties and prevent or avoid bad debts or lost time.

Contracted Services: Body Corporates

Active provides contracted services to body corporates. For Terms of Trade for body corporate clients please email info@buildingmanagers.co.nz and a copy will be sent to you.

Casual Sales: Sales to individuals or companies

Active provides ancillary goods and services to individuals within the body corporates that are under management of Active. These services include but are not limited to the following:

●  Sale of swipe tags

●  Sale of remotes

●  Sale of keys

●  Provision of lockout services

●  Enforcement of body corporate rules by charging an administration fee to repeat offenders

●  One off cleans or grounds maintenance

The prices for the above goods and services are fixed but will change from time to time depending on market conditions and changes to the input cost of goods and services. The prices are GST inclusive, unless stated otherwise. The prices are the actual prices for the goods or services and do not constitute a quote or estimate unless stated otherwise. In the event of a quote or estimate being provided, the price will be valid for 30 days from the date of issue.

The following payment terms are accepted:

●  Sale of swipe tags – 7 days. Delivery of goods within 5 working days after payment is received.

●  Sale of remotes – 7 days. Delivery of goods within 5 working days after payment is received.

●  Sale of keys – 7 days. Delivery of goods within 5 working days after payment is received.

●  Provision of lockout services – Payment on arrival. Contactless electronic payment available. Receipts are provided for cash payment.

●  Enforcement of body corporate rules by charging an administration fee to repeat offenders. 7 days.

● One-off cleans or grounds maintenance – 7 days.

No credit will be given to individual purchasers. Debt collection proceedings will be enforced if payment is not received within 7 days of the due date. The debtor will be liable for any legal costs in pursuance of the unpaid debt, including costs incurred by Active. Goods will be delivered to the purchasers letterbox if they are an owner occupier. Goods may also be collected from our office or courier delivery can be arranged at additional cost. Ownership of the goods transfers to the purchaser upon delivery. Faulty goods may be notified and returned to the Active office for replacement within 7 days. Reservation of Title under the Consumers Guarantees Act 1993 does not apply to our terms of trade. Active will not enter a private residence in order to retrieve an item that is faulty or not paid for in full. Active is not liable for any delay in providing goods or services due to situations beyond our control.

Disbursements on Purchases

A disbursement administration charge is applied (recoverable via monthly consumables invoice) to any purchases made by Active on behalf of the body corporate.
